Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MacDupl application and the macdupl.app website (together, the "Software" and "Site"), provided by [SELLER LEGAL NAME] ("we", "us", or "MacDupl"). By downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.

1. What MacDupl does

MacDupl is a macOS utility that creates isolated duplicate instances ("clones") of applications that are already installed on your own Mac. All duplication happens locally on your device. MacDupl does not distribute, host, or modify any third-party application on any server, and does not provide you with any third-party software.

2. License grant

Subject to these Terms and payment of any applicable fee, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on Macs that you own or control, for your own personal or internal business use. A paid license is a one-time purchase that does not expire and is not a subscription. You may not resell, sublicense, rent, or redistribute the Software, or remove or circumvent its licensing or trial mechanisms.

3. Free trial

The Software offers a 7-day free trial beginning at first launch. When the trial ends, clones you have already created and their data continue to work; you will be unable to create new clones until you purchase a license. We may change trial length or terms for future releases.

4. Purchases, payment, and Merchant of Record

Purchases are processed by our payment provider, Dodo Payments, acting as the Merchant of Record. This means Dodo Payments is the seller of record for your transaction and is responsible for billing, payment processing, and the calculation, collection, and remittance of applicable sales tax, VAT, or GST. Your purchase is also subject to Dodo Payments' terms and privacy policy. Upon purchase, a license key is issued and delivered to you by email; you activate it inside the Software.

5. Refunds

Because a free trial lets you fully evaluate the Software before buying, purchases are generally final. Where refunds are offered, they are handled by Dodo Payments in accordance with their refund policy and applicable consumer-protection law. MacDupl is an independent product. It is not affiliated with, sponsored by, or endorsed by the makers of any application it can clone. All third-party product names, logos, and trademarks are the property of their respective owners and are used, if at all, only for identification and descriptive purposes.

8. Updates

The Software may check for and install updates automatically (including security and compatibility fixes) using a signed update mechanism. Compatibility with third-party applications depends on those applications, which we do not control; an update to a cloned application may require you to regenerate the clone, and we do not guarantee ongoing compatibility with any specific application or macOS version.

9. Intellectual property

The Software, the Site, and all associated intellectual property are and remain our property or that of our licensors. These Terms grant you a license to use the Software, not ownership of it.

10. Disclaimer of warranties

The Software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with any particular application, account, or configuration.

11. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, accounts, profits, or goodwill, arising out of or relating to your use of the Software. Our total aggregate liability for any claim relating to the Software will not exceed the amount you paid for it in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Termination

These Terms apply for as long as you use the Software. We may suspend or terminate your license if you materially breach these Terms. On termination you must stop using and remove the Software; clones you have created are local artifacts on your Mac and remain under your control.

13. Governing law

These Terms are governed by the laws of [JURISDICTION — e.g., country and state/province], without regard to its conflict-of-laws rules. The courts located in [VENUE] will have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.
